Terms of Service

These Terms of Service (“Terms”) govern your use of the DialerX mobile application (“App”). “We”, “us”, and “our” refer to the publisher of DialerX. By installing or using the App, you agree to these Terms. If you do not agree, do not use the App.

EU / EEA / UK consumers. If you are a consumer habitually resident in the European Union, European Economic Area, or United Kingdom, mandatory consumer protection laws in your country of residence apply in addition to these Terms. Nothing in these Terms limits rights you have under those laws. For additional information on digital services, guarantees, and jurisdiction, see Section 12.

1. The App and Google Play

If you download the App from Google Play, your use is also subject to the Google Play Terms of Service and Google Play policies as between you and Google. In case of conflict between these Terms and Google’s terms regarding Google’s services, Google’s terms control for Google’s services.

2. Eligibility

You must be able to form a binding contract in your jurisdiction and meet any minimum age required by Google Play and applicable law. The App is not intended for children under the age digital products may lawfully be offered to in your region without parental involvement.

3. License

Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable license to install and use the App on devices you own or control, solely for lawful personal or internal business use in accordance with the documentation and permissions you grant.

You may not: copy the App except as allowed by law; reverse engineer, decompile, or disassemble the App except where mandatory law permits; rent, lease, sell, sublicense, or distribute the App; remove proprietary notices; or use the App to build a competing product.

4. Acceptable use and Play policy alignment

You agree to use the App only in compliance with applicable law and these Terms. You will not use the App to harass, threaten, defraud, spam, or violate others’ rights. You must comply with Google Play and Android requirements applicable to dialer/phone apps, including honest permission use, no malware, and no abuse of telephony or SMS capabilities.

We may suspend or stop providing the App where we reasonably believe you have breached these Terms or applicable law, or where required by Google or authorities.

5. Permissions and device role

The App may request sensitive permissions (phone, contacts, call log, microphone, camera for flashlight, SMS, notifications, etc.) solely to provide disclosed features. If you set the App as your default dialer or in-call UI, Android will route calls accordingly. You can revoke permissions or change defaults in device settings; some features may stop working.

6. Third-party services and carriers

Calls, SMS, and data connectivity depend on your carrier and device. Google, manufacturers, and other apps you use may process data under their own terms. We are not responsible for third-party services, rates, outages, or regulatory restrictions in your region.

7. Intellectual property

The App, its name, branding, and content (excluding your data and third-party materials) are owned by us or our licensors. No rights are granted except the limited license above.

8. Updates

We may issue updates (via Google Play or as required by law). Some updates may be mandatory for security or compliance. Continued use after an update may constitute acceptance of revised Terms if we notify you as required by law.

9. Disclaimer of warranties

To the fullest extent permitted by applicable law, the App is provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not warrant uninterrupted or error-free operation, compatibility with every device or network, or that the App will meet your requirements. Features depend on Android version, OEM customization, and carrier support (including conference calling and blocking APIs).

EU/UK consumers: Where you have mandatory statutory rights regarding conformity of digital content or services, those rights are not excluded to the extent they cannot be waived under your local law.

10. Limitation of liability

To the fullest extent permitted by applicable law, in no event shall we, our affiliates, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, goodwill, or business, arising from your use of the App.

Our aggregate liability for claims arising out of or related to the App shall not exceed the greater of (a) the amount you paid us for the App in the twelve (12) months before the claim or (b) zero (0) if the App is free.

Some jurisdictions do not allow certain limitations. In those jurisdictions, our liability is limited to the maximum permitted by law. Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or other liability that cannot be excluded under applicable law (including for consumers in the EU/UK).

11. Indemnity

To the extent permitted by applicable law, you agree to indemnify and hold harmless us and our affiliates from claims, damages, losses, and expenses (including reasonable legal fees) arising from your misuse of the App, violation of these Terms, or violation of third-party rights. This indemnity does not apply to consumers in the EU/UK where such clauses are unenforceable under mandatory consumer law.

12. EU / EEA / UK consumers — additional information

12.1 Free app — no purchases or publisher ads

DialerX is offered free of charge by us and does not include in-app purchases, subscriptions, or advertising served by us. You may still have statutory rights for free digital content or digital services under EU/UK consumer law (for example as to conformity), including remedies such as updates where legally required. Those rights are separate from any contract you have with Google for use of Google Play.

12.2 Dispute resolution

The European Commission provides an Online Dispute Resolution (ODR) platform. We are not obliged to use ODR unless required in your case. You may also have the right to bring proceedings in the courts of your country of residence.

13. Governing law and venue

Unless mandatory law provides otherwise, disputes are subject to the courts and laws that have jurisdiction under applicable rules. Consumers (EU/EEA/UK): You may benefit from mandatory rules of the country where you live, including suing in your local courts. Nothing in this section deprives you of those protections.

14. Export and sanctions

You may not use or export the App except as authorized by law, including export control and sanctions regulations.

15. Severability

If any provision is held invalid or unenforceable, the remaining provisions remain in effect, and the invalid provision shall be modified to the minimum extent necessary.

16. Entire agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the App and supersede prior understandings on the same subject, except for Google Play terms between you and Google. If you host only this file, replace the Privacy Policy link with your full public URL to the privacy policy if needed.
